At I Hear Your Pain, we are committed to protecting your privacy as a user of our App and services. We respect the privacy and confidentiality of the information provided by you and adhere to the Australian Privacy Principles established in the Privacy Act 1988 (Cth). Please read our Privacy Policy below carefully. You may query what is being collected and change your details at any time by advising us in writing via our contact details below.

IHYP is committed to protecting your privacy and the confidentiality and security of information provided by you to us. In terms of the relevant Privacy legislation, we ensure that your personal information will not be disclosed to others, except if required by law or other regulation.

IHYP only collects ‘personal information’ (which is information which identifies an individual or from which the individual’s identity may be reasonably ascertained) necessary to carry out its activities and services.

We will take all steps reasonably necessary to ensure that personal information is treated securely and in accordance with this Policy.

Once we have received your information, we implement strict security measures to mitigate unauthorized access risk. When possible, encryption is used both in transit and in storage. All third parties that process personal data on our behalf are required to keep that data secure.

I Hear Your Pain strives to ensure the security, integrity and privacy of Personal Data submitted to our App and website and we periodically update our security measures in light of current technologies.

Personal Information we collect.

We only collect the minimum amount of information required to provide our services. Using our app requires you to create an account using an email address. This email address is required to log into your account and if you need to retrieve a lost password. If you indicate that you are happy to receive updates, this email address will be used to provide information on new versions of the app or other information regarding improvements of changes to the app.

When you use our app, we collect and store the readings you enter, along with any other information you enter such as diagnosis, location of pain and alternative measures of the level of your pains. This information is stored in our system linked to the email address you provided. No other personal information is stored with this data. We do ask for or store your name or location.

Additional information collected when you contact us for help.

Whenever you contact IHYP for help, we collect your email address along with additional information you provide in your request so that we can provide you with assistance and improve our services. You can also contact IHYP on public forums such as Twitter, Facebook or through forums on our website; however, we cannot maintain the privacy of your communication to us if you contact us through these channels.

How we use Personal Information collected.

We use the information you provide to deliver our services. The readings you save are saved and made available to you when you use the application.

We will use information on sound readings you provide along with pain location and diagnosis information to help us assess how the IHYP concept and application can be used to match conditions, diseases, and injuries to sounds. In future these assessments my be used to provide suggestions to users of potential conditions that might align with the sounds they have selected.

The information you provide will be added to a database that matches sounds with diagnoses. No identifying information is saved in this process and there is no way the information saved in this database can be used to identify the individuals who have provided the readings and diagnosis. For this reason, if you ask to have your personal information removed from IHYP we will erase all the records that are linked to your personal account but we will be unable to identify and remove the information you have provided that have been added to the anonymous database of diagnoses and sound readings as there is no link between your details and that anonymised data.

We may also use the information you provide to improve IHYP, diagnose technical issues, and comply with legal and regulatory requirements. By using IHYP you grant us the right to analyse the information you provide in order to undertake research that will be used to assess how sounds can or can be linked to certain conditions, diseases or injuries. The results of that research may be used to improve IHYP and may be included in research papers. In none of these cases will there be any possibility that your identity could be associated with the readings you provide.

Sharing Your Information.

We do not sell, rent, or share your personal information with third parties for marketing purposes. We may share the email address you use to log in with our service providers who need it to provide our services, such as our hosting provider and analytics provider. We may from time to time need to disclose certain information, which may include your Personal Data, to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request. Also, I Hear Your Pain may use your Personal Data to protect the rights, property or safety of I Hear Your Pain, its customers or third parties.

If there is a change of control in one of our businesses (whether by merger, sale or otherwise) or a sale or transfer of its assets or customer information, your Personal Data could be disclosed to a potential purchaser under an agreement to maintain confidentiality or could be sold or transferred as part of that transaction. We would only disclose your information in good faith and where required by any of the above circumstances.

We may also provide anonymized data to selected research groups and individual researchers for research purposes. This data will be taken from our database of sounds and diagnoses and is completely anonymous. There is no way that the data provided to these researchers can be used to identify you. The results of these research projects may be presented in relevant publications, journals, and meetings.

Firebase

IHYP uses a suite of performance analysis and monitoring tools called Firebase, which is provided by Google LLC. Firebase allows us to monitor the overall performance and stability of our apps, implement internal version control, identify bugs and prioritize fixes. For this purpose Firebase collects your IP address, device identifier, as well as event and usage data related to your use of IHYP. This data will be transferred to and stored on a server in Australia and operated by Google LLC.

It is not possible to opt-out of Firebase as it is an essential tool that we require in order to provide a functioning IHYP app to you.

Enhancing your privacy
You could further enhance your privacy by creating an anonymous email account at sites such as Gmail or Hotmail and use this as the email account you use to sign up to our app.

Access to your Personal Information

You have the right to access, correct, or delete your personal information at any time. You can do this by contacting us at privacy@ihearyourpain.com. You also have the right to object to the processing of your personal information, and to restrict or withdraw your consent for us to use your personal information.

We will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

Security

Exclusions To Privacy Policy
This Privacy Policy does not and shall not apply to any unsolicited information you provide to us. This includes, but is not limited to, information posted to any public and social media forums, such as IHYP social media pages and websites (collectively, “Public Platforms”), including any ideas for new products or modifications to existing services, and other unsolicited submissions (collectively, “Unsolicited Information”). All such Unsolicited Information shall be deemed to be non-confidential and we shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.

As we plan to ensure our Privacy Policy remains current, this policy is subject to change. We may modify this policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on this App or website.
